By accessing, registering, or using our Services, you (“User,” “Customer,” or “Client”) agree to follow these Terms. If you do not agree with these Terms, please stop using our Services immediately.
1. User Eligibility
To use automessa.com, you must be at least 18 years old.
By using our Services, you confirm that:
You are legally capable of entering into these Terms.
You are using the Services for lawful business or personal purposes.
If you are using the Services on behalf of a company, you have the authority to bind that company to these Terms.
You agree to follow all applicable laws, Meta policies, WhatsApp Business policies, and third-party platform guidelines.
2. User Account Registration
To access certain features, you may be required to create an account.
You agree to provide accurate, complete, and updated information, including:
Full name
Email address
Phone number
Business name
Business details
Billing information, if applicable
You are responsible for keeping your account information updated.
We may suspend or restrict your account if the information provided is false, incomplete, misleading, or violates our policies.
3. Account Security
You are responsible for maintaining the confidentiality of your login credentials.
You agree not to:
Share your account login details with unauthorized users

4. User Responsibilities

Follow WhatsApp, Meta, Facebook, Instagram, and third-party platform policies
Obtain proper consent before uploading or messaging customer contacts
Use customer data responsibly and legally
Ensure your messages, campaigns, templates, and automation flows are compliant
Pay all applicable fees on time
Avoid spam, fraud, abuse, or misleading communication
Maintain the confidentiality of your account and business data
You are solely responsible for all content, data, contacts, campaigns, messages, templates, and automation activities performed through your account.
5. Acceptable Use Policy
You must not use automessa.com for:
Illegal, abusive, fraudulent, or misleading activities
Sending spam or unsolicited bulk messages
Sending prohibited, harmful, offensive, or deceptive content
Violating WhatsApp, Meta, Facebook, Instagram, or third-party policies
Uploading malware, viruses, harmful scripts, or malicious code
Attempting unauthorized access to systems, servers, APIs, or accounts
Misusing automation tools, APIs, or messaging systems
Collecting or using customer data without proper consent
Sending messages that violate privacy, telecom, consumer protection, or data protection laws
Violation of this section may result in immediate suspension or termination of your account without refund.
6. WhatsApp Business API & Meta Compliance
If you use WhatsApp Business API, Facebook, Instagram, Messenger, or any Meta-related service through automessa.com, you agree to comply with Meta’s policies and approval requirements.
You understand that Meta/WhatsApp has full control over:
Business verification approval
WhatsApp Business API approval
Display name approval
GreenTick verification
Message template approval
Campaign restrictions
Account quality status
Messaging limits
Account suspension or restrictions
automessa.com may assist with setup, integration, and verification guidance, but we do not guarantee any approval from Meta, WhatsApp, or third-party platforms.
7. Customer Data & Consent
You are responsible for obtaining valid consent from your customers, leads, contacts, or users before uploading, storing, processing, or messaging them through our platform.
You confirm that:
You have lawful permission to use all uploaded customer data.
Your contacts have agreed to receive communication from you.
You will not upload purchased, scraped, unauthorized, or illegally collected data.
You will comply with applicable data protection and privacy laws.
automessa.com may access and process message logs, automation flows, CRM data, campaign data, and customer interaction records only for providing, supporting, improving, and securing the Services.
We are not responsible for claims, complaints, penalties, or legal actions caused by your misuse of customer data.
8. Payments, Subscription & Recharge
All prices are listed in INR (₹), unless otherwise stated, and are exclusive of applicable taxes.
You agree to pay all charges related to your selected plan, subscription, message credits, API usage, setup fees, add-ons, custom integrations, or third-party charges.
Certain services may require:
Advance subscription payment
Minimum recharge amount
Message credit balance
Setup charges
API usage charges
Third-party platform fees
Failure to make payment on time may result in suspension, limitation, or termination of your account.
9. Refund Policy
Once a service is activated, payments are non-refundable unless required by applicable law or clearly mentioned in our Refund Policy.
Non-refundable services may include:
Subscription fees after activation
WhatsApp API setup charges
GreenTick assistance fees
Meta verification assistance fees
Custom integration charges
Message credits already used
Third-party charges
Paid add-ons
Consultation or onboarding fees
No refund will be provided if your account is suspended or terminated due to violation of these Terms.
10. GreenTick & Verification Services
automessa.com may provide assistance for WhatsApp Business Verification, Meta Business verification, display name approval, and GreenTick verification.
However, final approval is completely controlled by Meta/WhatsApp.
We do not guarantee:
GreenTick approval
Meta Business verification approval
WhatsApp API approval
Display name approval
Template approval
Messaging limit increase
Campaign approval
Fees paid for GreenTick, verification, or related assistance are non-refundable once the process has started or submission has been made.
11. User Content & Campaigns
You are fully responsible for all content created, uploaded, sent, or managed through your account, including:
Message templates
Broadcast campaigns
Automation flows
Chatbot replies
Media files
Customer lists
CRM records
Promotional messages
Transactional messages
You agree not to send content that is illegal, abusive, misleading, offensive, defamatory, harassing, fraudulent, or prohibited by applicable laws or platform policies.
We reserve the right to review, restrict, remove, or block any content that violates these Terms or creates risk for our platform.
12. Message Delivery Disclaimer
Message delivery depends on multiple external factors, including Meta/WhatsApp systems, telecom networks, recipient availability, template approval, account quality, internet connectivity, and third-party infrastructure.
automessa.com does not guarantee:
100% message delivery
Specific delivery time
Read rate
Reply rate
Lead generation results
Sales conversion
Campaign performance
Template approval
Continuous API access
You are responsible for ensuring that all communication is consent-based and policy-compliant.
13. Third-Party Services
Our Services may integrate with third-party platforms such as:
Meta
WhatsApp
Facebook
Instagram
Messenger
Shopify
WooCommerce
Payment gateways
CRM tools
Email services
Cloud or analytics platforms
We are not responsible for third-party downtime, API changes, pricing changes, account restrictions, policy updates, data loss, or service interruptions.
Your use of third-party services is governed by their own terms and policies.
14. Intellectual Property
All trademarks, logos, software, designs, source code, dashboards, workflows, features, content, documentation, and technology related to automessa.com are owned by automessa.com or its licensors.
You receive a limited, non-exclusive, non-transferable, and revocable license to use our Services according to these Terms.
You may not:
Copy or reproduce our platform
Reverse-engineer our software
Resell or redistribute our Services without permission
Modify, duplicate, or exploit our technology
Use our brand name, logo, or content without written approval
Create competing products using our platform design, workflows, or features
15. Service Availability
We aim to provide reliable service, but we do not guarantee uninterrupted, error-free, or 100% available service.
Service may be affected by:
Scheduled maintenance
Emergency maintenance
Server issues
Internet failures
API limitations
Meta/WhatsApp downtime
Third-party outages
Security updates
Force majeure events
automessa.com shall not be liable for losses caused by downtime, message failure, delay, API interruption, or third-party service issues.
16. Suspension & Termination
You may stop using our Services or request account termination at any time by contacting us.
We may suspend, restrict, or terminate your account if:
You violate these Terms
You fail to pay applicable fees
You misuse APIs, automation tools, or messaging services
You send spam or prohibited content
You violate Meta, WhatsApp, or third-party policies
Your account creates legal, technical, security, or reputational risk
You misuse customer data
You engage in fraudulent or unlawful activity
After termination, your account data may be deleted, restricted, or retained only as required for legal, tax, compliance, security, or operational purposes.
17. Limitation of Liability
To the maximum extent permitted by law, automessa.com shall not be liable for indirect, incidental, special, consequential, punitive, or business-related damages.
This includes but is not limited to:
Loss of revenue
Loss of profit
Loss of customers
Loss of business opportunity
Loss of data
Message delivery failure
API downtime
Meta or WhatsApp restrictions
GreenTick rejection
Campaign failure
Customer complaints caused by your misuse
Our total liability shall be limited to the amount paid by you to automessa.com for the Services during the last 12 months.
18. Indemnification
You agree to indemnify and hold harmless automessa.com, its owners, employees, partners, vendors, affiliates, and service providers from any claims, damages, losses, penalties, legal fees, or expenses arising from:
Your use or misuse of the Services
Your violation of these Terms
Your violation of Meta, WhatsApp, or third-party policies
Your violation of applicable laws
Your failure to obtain customer consent
Your misuse of customer data
Your message content, campaigns, templates, or automation flows
Any complaint, claim, or legal action made by your customers or third parties
19. Changes to User Terms
We may update, modify, or replace these User Terms & Conditions at any time.
Updated Terms will be posted on this page with a revised “Last Updated” date.
Your continued use of the Services after changes are posted means that you accept the updated Terms.
We recommend reviewing this page periodically.
20. Governing Law & Jurisdiction
These Terms shall be governed by and interpreted according to the laws of India.
Any disputes arising from these Terms, your use of the Services, payments, service delivery, or platform usage shall be subject to the jurisdiction of the courts located in Ahmedabad, Gujarat, India.
Where applicable, arbitration or mediation may be required before litigation in accordance with applicable law.
